Abstract

Employment social security constitutes a vital component of the legal protection afforded to employees within the employment relationship. In practice, fulfilling a worker's right to BPJS  (Employment Social Security) extends beyond mere registration as a participant; it encompasses the company's obligations regarding data submission, contribution payments, and the provision of access to social security benefits. This study aims to analyze the implementation of employees' rights regarding BPJS at PT Sahabat Unggul Internasional and to assess its compliance with legal provisions, specifically Law Number 6 of 2023 concerning Job Creation. The study employs a socio-legal method with a descriptive-analytical approach. Data were gathered through interviews, observations, documentation reviews, and literature studies. A qualitative analysis was conducted by comparing field findings with statutory regulations governing employment and social security. The results indicate that the implementation of BPJS Ketenagakerjaan is proceeding effectively regarding participation, worker registration, data submission, and contribution payments. However, the optimal fulfillment of workers' rights is not determined solely by administrative compliance, workers' understanding of their rights and benefits, as well as their access to those benefits, are also crucial elements of protection. The study concludes that enhanced dissemination of information, improved data management, and better oversight of participation are necessary to ensure that legal protection for workers functions effectively and sustainably.
